These Terms of Service ("Terms") govern your access to and use of the Whatsoza website at whatsoza.com (the "Website") and any enquiry you make through it. Whatsoza ("we", "us", "our") is a brand operated by Ozavion Limited, a company registered in England and Wales (company no. 16814450), registered office 86-90 Paul Street, London, EC2A 4NE, United Kingdom. By using the Website you agree to these Terms. If you do not agree, please do not use the Website.
1. Website vs. paid Services
These Terms cover your use of the Website and informational content only. Our WhatsApp Business API, automation, integration and managed services (the "Services") are provided under a separate written agreement, proposal or order form ("Services Agreement"). If anything in these Terms conflicts with a signed Services Agreement, the Services Agreement prevails for the Services it covers.
2. Eligibility and business use
The Website is intended for business and professional use by people aged 18 or over with authority to act for their organisation. You agree that the information you provide to us is accurate and that you are authorised to provide it.
3. Enquiries are not an offer or guarantee
Content on the Website — including descriptions of Services, benchmarks, sample outcomes and pricing models — is for general information. It is not a binding offer and does not guarantee any particular result. Any demonstration figures or case examples shown are illustrative. A binding engagement arises only through a signed Services Agreement.
4. Acceptable use
You agree not to:
- use the Website unlawfully, or in breach of any applicable regulation or third-party rights;
- attempt to gain unauthorised access to, disrupt, or probe the Website or its infrastructure;
- scrape, data-mine, or harvest content or personal data except as expressly permitted;
- upload or transmit malicious code, or use the Website to send spam or unsolicited messaging;
- misrepresent your identity or affiliation, or submit another person's data without authority.
5. Intellectual property
The Website and its content — text, graphics, logos, diagrams, layouts, and software — are owned by or licensed to Ozavion Limited (operating the Whatsoza brand) and are protected by intellectual-property laws. You may view and print pages for your own internal, non-commercial evaluation. You may not copy, republish, distribute, modify or create derivative works from the Website without our prior written consent. "Whatsoza" and our logos are our trademarks; other names and marks (including "WhatsApp", which is a trademark of Meta Platforms, Inc.) belong to their respective owners, and our use of them does not imply endorsement.
6. Third-party platforms and compliance
Our Services operate on the WhatsApp Business Platform and other third-party systems whose use is subject to those providers' own terms and policies (including Meta's and WhatsApp's Business Terms, Messaging Policy and Commerce Policy). Where you use such platforms, you are responsible for complying with their terms, for obtaining valid opt-in/consent from your recipients, and for the lawfulness of your messaging content. Whatsoza is a Meta Verified Tech Provider but is not Meta and does not control the WhatsApp platform.
7. Links and third-party content
The Website may contain links to third-party websites and resources we do not control. We provide them for convenience and are not responsible for their content, products or practices.
8. Disclaimers
The Website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement, and we do not warrant that the Website will be uninterrupted, error-free or secure. Nothing in these Terms limits warranties or rights that cannot be excluded under applicable law.
9. Limitation of liability
To the fullest extent permitted by law, Ozavion Limited (operating Whatsoza) will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Website. Our total aggregate liability arising from your use of the Website is limited to £100 (one hundred pounds). Liability under any Services Agreement is governed by that agreement. Nothing here excludes liability that cannot lawfully be excluded (such as for death or personal injury caused by negligence, or fraud).
10. Indemnity
You agree to indemnify and hold harmless Ozavion Limited (operating Whatsoza) from claims, losses and expenses arising from your breach of these Terms or your misuse of the Website.
11. Changes to the Website and these Terms
We may modify or discontinue the Website (or parts of it) at any time, and we may update these Terms from time to time. Changes take effect when posted here with a revised "Last updated" date; your continued use of the Website means you accept the updated Terms.
12. Governing law and disputes
